Defense lawyers for student leaders Joshua Wong Chi-fung and Lester Shum urged the High Court to abandon the summons against 20 activists charged with contempt of court for their actions during the Occupy Movement in Mong Kok.
They were charged with ignoring an injunction in Nathan Road when the police were attempting to clear the streets a year ago.
One of the defense lawyers, Gerald McCoy, said yesterday the Judiciary had failed to submit documents to the court for the defendants to receive within 14 days of the issue of summons in April and the court was not notified of the passing of the legal deadline.
As his clients had still not received these documents, McCoy proposed that the charges should be declared invalid.
Outside court, he said amendments to the original summons made by the Judiciary in July were "unconvincing."
Another defense lawyer, Lawrence Lok Ying-kam, described the amendments by the prosecution as "playing tricks."
Justice Anderson Chow Ka-ming agreed to delay the hearing until February 25.
Meanwhile, two logistics workers who were convicted for throwing eggs at Joshua Wong outside Kowloon City Court last November, were jailed for two-weeks.
Li Wong, 27 and Cheung Ka-shing, 33, were earlier fined HK$3,000 each after trial. But the Judiciary later appealed saying the fine was too lenient. KINLING LO
