The Court of First Instance says an appeal by the founder of Civic Passion, Wong Yeung-tat, against his conviction for unlawful assembly, lacked legal and factual support.
Wong was earlier fined HK$5,000 by a magistrate for storming the Legislative Council complex together with about a dozen other people in June last year, to protest against the government's funding request for the development of northeast New Territories.
In handing down the reasons for dismissing Wong's appeal which was heard last month, Justice Derek Pang also rejected Wong's arguments that it was unreasonable for the magistrate to rule that the storming had made innocent third parties feel afraid of what was going on as they only comprised the police, security guards and reporters.
The judge said the fact these people were carrying out their duties did not mean they had not become frightened of what was happening at the scene.
