A judge has found a democracy protester not guilty of obstructing the police after throwing out evidence by an officer for “untrustworthy statements” to the court.
Deputy Magistrate Peter Hui scolded Ho Yu-hin, who was testifying in a case where 27-year-old chef Lau Tsz-on was facing a charge of obstructing police officers during last year’s street protests.
Lau was accused of repeatedly charging police lines in an Oct. 15 incident outside government headquarters in Admiralty.
Ho said Lau grabbed his arm as the defendant was being restrained by other officers.
However, three video clips submitted by the defense, showed Lau being sprayed by a policeman with what appeared to be pepper spray, causing the defendant to fall to the ground.
Lau’s lawyer said his client never behaved as described by Ho.
After seeing the video evidence, Hui ruled that Ho’s testimony had become self-contradictory.
