Hong Kong Broadband Network (HKBN) has been fined HK$30,000 by Tsuen Wan Court for using the personal data of a client for direct marketing purposes without his consent, in a landmark ruling since laws regulating such practices were changed two years ago.
Magistrate Debbie Ng said the company had used an end-of-contract reminder as a decoy to try and sell different internet service plans to an existing customer - even though he had already asked his name to be removed from a sales list. She said HKBN did not try all possible means to avoid breaking the rules.
The offence took place in May 2013, more than half a year before the customer's contract was due to expire. Ng said the period was too long if the company just wanted to remind the customer that his contract was going to expire.
