Nuisance-call charge dropped in Franklin Chu case

The Department of Justice has dropped charges against a 30-year-old man who made numerous phone calls to retired police superintendent Franklin Chu – who allegedly bashed Occupy protesters with his baton last year.

Lawrence Tsui was to go on trial in Tsuen Wan Court on Wednesday morning. But the prosecution decided not to proceed with charges of "making persistent phone calls" against him. He was instead ordered to sign an 18-month good-behaviour bond which does not leave a criminal record.

Tsui made 13 calls to the former Sha Tin district commander's mobile phone and his home within three days last year.

In a previous hearing, Deputy Magistrate Jim Chun-ki noted that Chu in fact never answered any of the calls. He also questioned whether 13 calls in three days should have resulted in Tsui being charged with making persistent calls.

Chu’s telephone numbers were posted online after he was filmed batting protesters outside the Mong Kok Police Station on November 26 last year.

The Independent Police Complaints Council later ruled what he did amounted to assault. But no legal action has been taken against him so far.

Two other people earlier pleaded guilty to making nuisance calls to Chu, who retired in July this year.
