The Secretary for Justice Rimsky Yuen said the government is yet to receive the report against a now-retired superintendent who was filmed hitting Occupy protesters with his baton last year, and the Department of Justice will decide what to do next only after getting it.
The police's internal complaint unit said on Monday that it has accepted the conclusion of the Independent Police Complaints Council (IPCC), that the complaints against Franklin Chu were justified. But Yuen said he had not received the relevant reports from the police.
Yuen said the Department of Justice would look into the evidence in the same way it deals with other criminal cases, before deciding whether to follow up or not.
The IPCC said the former officer's action amounted to an assault. The Complaints Against Police Office (Capo) earlier rejected the council's ruling, but will now deal with the complaint.
However, Civic Party leader and legislator Alan Leong says the U-turn by Capo comes too late. He said they shouldn't have taken this long to come around to admitting that Chu did assault civilians.
"It was so blatantly and unequivocally shown on TV news clips that I really don't think there can be two ways about a conclusion. The conclusion must be that Mr Chu was abusing his power while on duty as a police officer and he committed, at least on the face of it, a prima facie case of assault," he said.
