The police will submit a long-awaited report to its watchdog by next week which will unveil whether the force would stick to their guns that a retired senior police officer did not attack a passer-by with his baton during the Occupy protests last year, and if he would be prosecuted.

Officers from the Complaints Against Police Office told the police watchdog on Tuesday that they had received legal advice from the Department of Justice on Monday, and it would take them a week to review the documents and compile a written report.

The Independent Police Complaints Council ruled in June that retired superintendent Franklin Chu assaulted a pedestrian with his baton during a protest in Mong Kok on November 26.

IPCC chairman Larry Kwok said the police watchdog will closely examine the report before deciding on the next step. 

When asked if the government has been dragging its feet on the case, Kwok said it is not unusual for the justice department to take months, as it involved complicated legal and factual issues.
