Occupy protester Ken Tsang has urged the court not to allow the prosecution to use a news footage from ATV in the trial against him, claiming doubts about its authenticity.
Prosecutors said he had splashed a liquid on 11 policemen in October 2014 in Tamar Park. But Tsang has denied having assaulted or resisted police officers.
At the trial, which began at the Kowloon City Magistrates' Court on Monday, Tsang's lawyer said the source of the ATV clip is unknown because the prosecution has been unable to find the master tape after visiting the station’s headquarters. There's also no proof that it hasn't been tampered. Therefore, he said officers simply cannot use the clip to carry out an identity parade.
The magistrate is yet to make a decision on the matter.
Besides the ATV clip, the prosecution will also submit several other video clippings recorded by officers that reportedly captured Tsang splashing the liquid on police officers.
The trial is expected to last five days.
Tsang is also involved in another case where seven police officers are charged with beating him up at Tamar Park following his arrest. That case will be heard in June.
